Haven't Filed US Taxes for Years? The Streamlined Program — Catch Up Without Penalties
Many US citizens in Israel didn't know they had to file. The IRS offers a special path for those who "didn't know" — filing 3 tax years, no penalty, and in most cases no tax owed. How it works and who qualifies.

Few moments are more stressful for a US citizen in Israel than this one: suddenly discovering — through the bank, a friend, or an innocent Google search — that they were supposed to file US tax returns all those years, and simply didn't know. The good news: the IRS knows most of these people genuinely didn't know, and it built an orderly path to fix it — without penalties. It's called the Streamlined Foreign Offshore Procedures.
What the program is
Streamlined is an official IRS program that lets citizens living abroad who didn't file — out of non-awareness, not intent to evade — regularize their status. As of 2026 the program is still active. And for those living outside the US, the penalty is zero.
What you need to file
- The three most recent tax-year returns (Form 1040) whose deadlines have passed
- Six years of FBAR reports (foreign financial accounts)
- Form 14653 — a certification that the non-filing was "non-willful," with a genuine explanation
The critical condition: "non-willful"
The program is open only to those who can honestly certify that the non-filing stemmed from lack of knowledge or misunderstanding of the law — not deliberate evasion, and the IRS does review the explanation. But for most Israeli-Americans, who simply didn't know that US citizenship carries a worldwide filing duty — this is exactly the situation the program was built for.
The second requirement: physical presence abroad
To enjoy the "zero penalty" track you also have to meet a residence condition: presence outside the US for at least 330 days in one of the three relevant tax years. Most Israeli-Americans living here meet this almost automatically.
Why "no tax owed" is realistic
The most common fear is a huge bill — and in practice, most Israeli-Americans owe no US tax at all. The reason: the tax they paid in Israel offsets the US liability (Foreign Tax Credit), and/or the income is excluded from it (FEIE). The typical result: an orderly file, zero penalty, zero tax — and sometimes even a refund (Child Tax Credit) along the way.
Why you should act early
There's one condition here that decides everything: the program is open only to those who come forward voluntarily, before the IRS or the bank "caught" them. Once a proactive contact from the tax authority arrives, the window may close. And that's exactly why anyone who received a FATCA letter from the bank should act fast — before the information reaches the IRS.
